Silk Sundaes
General Event Policy and Terms of Attendance
Effective date: 9 October 2026Last updated: 9 October 2026
In short: know the rules before you arrive, look after each other, and understand who is running your event. We have zero tolerance for gender-based violence (GBV) and harassment. Every event names its Promoter, and this Policy is the minimum standard for all of them. Payments are handled by Yoco and Paystack, and our website runs on Wix, so their terms apply alongside ours (section 2).
Emergency or need help at an event? Speak to any staff member or security guard. SAPS: 10111. GBV Command Centre (free, 24 hours): 0800 428 428.
Scope and promoters
- This General Event Policy ("Policy") applies to every event held under the Silk Sundaes name or brand ("Event"), of any type, including parties, club nights, festivals, markets, pop-ups, dinners, workshops, live performances and private or ticketed hires.
- Some Events are run by independent promoters or organisers under licence from Silk Sundaes ("Promoter"). The Event page, ticket and booking confirmation will name the Promoter and how to contact them. If no Promoter is named, Silk Sundaes is the organiser.
- The Promoter runs its Event, including the venue, permits, security, suppliers, staff, ticket sales, refunds and cancellations. Silk Sundaes owns the brand, sets the minimum standards in this Policy, and may act if a Promoter does not meet them (see section 13). "We", "us" and "our" mean Silk Sundaes and, for a particular Event, its Promoter, as the context requires.
- Nothing in this Policy removes any responsibility that Silk Sundaes or a Promoter has to you under law, including as a supplier, marketer or seller under the Consumer Protection Act 68 of 2008 ("CPA").
- A Promoter may add Event-specific terms (for example a dress code, age limit, venue rules or catering terms). They must be shown before you pay, may be stricter than this Policy, but may never reduce your rights under this Policy or the law. Where this Policy and Event-specific terms conflict, the one more favourable to you applies.
- By buying a ticket, registering, or entering an Event, you ("Customer" or "Attendee") confirm that you have read, understood and accepted this Policy and any Event-specific terms. If you buy for other people, you must tell them about this Policy, and you remain responsible for your guests' compliance.
- You must be 18 or older to buy a ticket. A person under 18 may attend only as allowed in section 4, with a parent or guardian who has accepted this Policy.
- Statements by staff do not change this Policy unless confirmed in writing by the Promoter or Silk Sundaes. Headings are for convenience, and "including" means "including but not limited to".
Our website, payment providers and their terms
- Our website is built and hosted on Wix. Online card and EFT payments are processed by Yoco and/or Paystack (the "Payment Providers"). The provider used for your purchase is shown at checkout. Our Instagram account (@silk.sundaes) is a Meta platform and is separate from these services.
- This Policy must be read together with the terms of service and privacy policies of Wix, Yoco and Paystack, as published on their websites and in force when you use them. By using our website and paying through these providers, you also accept their terms for the services they provide to you.
- Order of precedence: for admission, conduct, safety, Event changes, cancellations and refunds, this Policy applies. For payment authorisation, card security, fraud checks, settlement, chargebacks and how funds move between banks, the Payment Provider's terms apply. If they conflict on a matter that affects your legal rights as a consumer, the position more favourable to you applies, and the law overrides both.
- Wix, Yoco and Paystack are independent companies. We do not control their systems. We are not responsible for outages or delays on their side, but we will help you resolve any problem with a purchase and will not use a provider's failure as a reason to deny a refund you are entitled to.
- We do not see or store your full card number, CVV or PIN. Card details are handled by the Payment Provider under its security standards, and your bank may require 3-D Secure authentication.
- Wix and the Payment Providers may use cookies, analytics and fraud-prevention tools, and may process information outside South Africa, including in the United States, Europe and Nigeria. Section 12 explains how we protect your information when it is shared with them.
- Stay safe from scams. We will never ask for your card PIN, OTP or online banking password, and we will not ask you to send full card or ID numbers by direct message. Buy tickets only through the official website, checkout links or accounts shown on this site. Check that a Promoter is named on the Event page before paying.
- If a payment fails but you were debited, or you were charged twice, contact us with proof of payment. Duplicate or failed-but-debited charges will be reconciled with the Payment Provider and corrected or refunded.
Tickets and purchase
- Prices are in South African Rand (ZAR) and include VAT where applicable. Booking, service or processing fees, and any delivery fee, are shown before you pay.
- Your agreement with us is concluded when your payment is confirmed and a booking reference is sent to you. Please check your confirmation immediately.
- Check the name, date, time, venue, ticket type and quantity before paying. Tell us promptly if anything is wrong. We will correct genuine errors, or refund you in full if we cannot.
- Tickets are usually delivered digitally with a QR code or booking reference. Keep it private. Each code works once, so whoever scans first is admitted, and we cannot refund a ticket that was copied or shared by you.
- If you lose your ticket, contact us with your proof of payment and photo ID, and we will reissue it where we can verify the purchase. The old code will be cancelled.
- Ticket limits, ticket tiers, early-bird, promotional, group or bundle terms are shown at purchase. Terms that exclude refunds or transfers for a ticket type must be clearly displayed before you buy.
- We may cancel a purchase, with a full refund, if it was made in bulk or by automated means, is suspected to be fraudulent, or has an obvious pricing error. We will not use this right unfairly.
- The refund periods in this Policy are our contractual terms. They do not remove any statutory right, including any cooling-off right that applies under the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"). Please note that ECTA excludes certain leisure and catering services booked for a specific date from the cooling-off right.
Admission and entry
- Entry requires a valid ticket or confirmed booking. Tickets that are duplicated, altered, cancelled or sold in breach of section 10 will be refused.
- Age limits apply as stated for each Event. You may be asked for valid photo ID (smart ID card, ID book, passport or driving licence). Without proof of age you may be refused entry or refused alcohol, with no refund.
- Children may attend only where the Event says they are welcome, and must be supervised by a responsible adult at all times. Parents and guardians are responsible for their children's behaviour and safety. Lost children will be taken to a staff member or the information point.
- For everyone's safety, security may search bags and persons at entry, respectfully and, where possible, by someone of the same gender. If you do not agree to a search, you may be refused entry.
- The following may not be brought in unless the Event page allows it: weapons and anything that could be used to hurt someone; fireworks, flares and laser pens; illegal drugs and paraphernalia; glass bottles; outside food and drinks (see section 7); professional cameras, recording equipment and drones; large bags, umbrellas with sharp points, and any item the venue or security reasonably regards as unsafe. Prohibited items may be confiscated and handed to the police where unlawful, or returned or disposed of as the venue decides.
- Dress codes and other entry criteria must be advertised in advance and applied consistently. Right of admission is reserved but is never exercised on grounds of race, gender, sexual orientation, gender identity, religion, disability, or any other unfair discrimination.
- We will refuse or end entry for people who are very intoxicated, aggressive, in breach of this Policy, or who are not safe to be in a crowd. Where entry is refused for a reason in this Policy, no refund is due. Where entry is refused because of our error, or because the Event was oversold, you are entitled to a refund.
- Accessibility: where possible we provide step-free entry, accessible toilets and seating, priority entry and a companion ticket. Contact the Promoter before the Event so arrangements can be made. Assistance dogs are welcome. Reasonable medication and medical devices are allowed, with proof if requested.
- Wristbands or stamps may be used for access, age verification and re-entry. Do not remove or share them. Lost or damaged wristbands may not be replaced without proof of the original.
- Re-entry is allowed only where the Event says so. Latecomers are admitted at the Promoter's discretion. Venue capacity limits are strict, and queues must be orderly. Smoking and vaping are permitted only in designated areas, as the law allows.
Conduct, safety and emergencies
- You must follow reasonable instructions from staff, security, marshals, medics and emergency services. In an evacuation, stay calm, leave through the nearest marked exit and leave your belongings behind.
- Do not climb on structures, enter restricted or backstage areas, obstruct exits, or block aisles. Do not throw items, and do not push or surge in crowds. If you see a hazard, tell a staff member.
- First aid and medical staff will be available as required by the Event's safety plan. By attending, you agree that we may arrange emergency medical help for you if you cannot ask for it yourself.
- Illegal drugs are not allowed. Sale or supply is reported to the police. If you need help because of drugs or alcohol, ask medics, who will assist you without judgment.
- Harassment, hate speech, discrimination, threats and violence directed at other Attendees, staff, vendors or performers are not tolerated. Take care with crowd safety, noise and hearing protection, as venues may have sound level limits.
- Do not drive under the influence. Arrange safe transport in advance. Staff will help you find safe transport or contact someone you trust.
- Weather, load-shedding, security risks or instructions from authorities may require changes to an Event. We will try to keep you informed on-site and on Instagram, and section 9 explains your rights if an Event is changed or stopped.
- For breaches of this Policy we may issue a warning, remove you without a refund, ban you from future Events, share details with other Silk Sundaes Promoters for safety purposes (in line with section 12), and report you to the police.
Gender-based violence (GBV) and harassment: zero tolerance
- Silk Sundaes Events must be safe, welcoming spaces. We have zero tolerance for gender-based violence, sexual harassment, sexual assault, stalking, intimidation, domestic and intimate-partner violence, and discrimination. This applies whether the conduct is physical, verbal, digital or visual, and applies to Attendees, staff, vendors, performers and Promoters equally.
- Unacceptable behaviour includes: unwanted touching, groping, grinding, kissing or sexual comments; following, cornering or blocking someone; continuing after "no" or after someone has shown disinterest; spiking, or tampering with, a person's food or drink; pressuring, threatening or coercing someone sexually; taking, sharing or threatening to share intimate or degrading images without consent; and violence or threats against a partner, family member or friend at an Event.
- Consent must be clear, informed and freely given, and it can be withdrawn at any time. A person who is intoxicated, unconscious, afraid, or being pressured cannot consent. Rape, sexual assault and other sexual offences are crimes under the Criminal Law (Sexual Offences and Related Matters) Amendment Act 32 of 2007, and harassment is addressed by the Protection from Harassment Act 17 of 2011.
- How to report: tell any staff member, security guard or the Event's designated safety contact, or message @silk.sundaes on Instagram during or after the Event. You can report for yourself or on behalf of someone else, and bystanders are encouraged to speak up. Reports can be made at any time, including after an Event, and we will take them seriously.
- What we will do: believe you and treat you with respect, without blaming you for what you wore, drank or where you were. Take you or the affected person to a safe, private place and stay with you if you wish. Offer help to contact a friend or family member, arrange safe transport, and arrange medical care. Respect your decision about whether to involve the police, while explaining your options and offering to help you report. Speak to the person who is alleged to have caused harm and, where appropriate, separate you from them. Remove them from the Event, ban them, and cooperate with police.
- If you have been sexually assaulted, medical attention as early as possible is important, and ideally within 72 hours, so that you can receive post-exposure prophylaxis (PEP), emergency contraception and care. Try not to wash, and keep clothing or a drink you believe was tampered with, as it may help the police. A Thuthuzela Care Centre or any public hospital or clinic can help. You do not have to decide about a police case immediately.
- Confidentiality: reports are kept confidential and shared only with those who need to know to respond safely and fairly, or where the law requires. Some reports must be passed on regardless, for example any suspected sexual offence or abuse involving a child under the Children's Act 38 of 2005 or the Sexual Offences Act. We will tell you if we must disclose.
- No retaliation. Nobody will be punished, removed or treated worse for reporting in good faith, even if the report cannot be proven. Deliberately false reports intended to harm someone may lead to action.
- Drink spiking: if you or a friend feel unusually drunk, dizzy, drowsy or unwell, tell staff straight away. Do not leave the person alone. Medics will help, and we will take steps to preserve evidence.
- Staff and security at every Event must be briefed on this section. Promoters must make the reporting process visible (for example by signs, announcements and at the bar and toilets), and must report serious incidents to Silk Sundaes within 48 hours.
- Support lines (South Africa): GBV Command Centre 0800 428 428 (free, 24 hours); Stop Gender Violence Helpline 0800 150 150 (free, 24 hours); SAPS emergency 10111. Please check that numbers are current before relying on them.
Food, drinks and alcohol
- Food and drinks are sold by the Promoter or licensed vendors. Outside food and drinks are not allowed, except baby food, medically necessary items, and food for allergies or dietary needs, which may be inspected. "Bring your own" Events are allowed only where the Event page says so.
- Alcohol is sold only by licensed sellers, within the licensed area, and only to people 18 or older, in line with the Liquor Act 59 of 2003 and the venue's licence. We may ask for ID, and we do not serve anyone who appears intoxicated. Alcohol may not be bought for or passed to anyone under 18, and drinks may not be taken out of the licensed area.
- Vendors must comply with food safety, hygiene and labelling laws and hold valid certificates of acceptability where required. We display allergen information where available, but we cannot guarantee that any food or drink is free of allergens, because of shared kitchens and suppliers. If you have an allergy, tell the vendor before ordering and carry your own medication.
- If you are unwell or you buy food or drink that is unsafe, not as described or poorly prepared, tell the vendor or Promoter immediately so that we can help, record the incident and correct the problem. You have rights to safe goods and a refund or replacement under the CPA.
- Look after your drink and do not accept drinks from strangers. Free drinking water will be available at Events where required by the safety plan.
- Cashless, token or voucher systems may be used. The terms for top-ups, expiry and unused balances will be displayed at the Event and will comply with the law, and vouchers will not expire in under three years unless the law allows.
- For seated dinners, tastings and catered Events with a fixed headcount, specific dietary requirements must be provided in advance. Different cancellation or no-show terms, which reflect real catering costs, may apply if shown at booking.
- Tips are optional. Vendors may have their own terms of sale, which must not conflict with this Policy or your rights.
Damage, loss and liability
- You are responsible for loss or damage to the venue, equipment, décor, vehicles or property caused by you or your guests. We may recover the reasonable cost of repair or replacement from you. Where it is practical, we will show you what happened and how the cost was calculated before charging you.
- If damage is caused by a group, each member of the group who was involved is responsible. If the person who caused it cannot be identified, the person who booked or hosted the group may be asked to contribute only where that was disclosed to them beforehand, such as in a private hire or table booking agreement.
- Look after your belongings. Subject to clause 8.5, we are not responsible for lost, stolen or damaged personal items, including phones, wallets, jewellery and items left in vehicles, or harm that we could not reasonably have prevented. Report theft to security and the police.
- Where cloakrooms or lost property are offered, the Promoter operates them. Report lost items before leaving or within a reasonable time afterwards. Unclaimed items are kept for a reasonable period and then donated or disposed of, with ID required for collection.
- Nothing in this Policy excludes or limits our liability for death or personal injury caused by negligence, for gross negligence, fraud or wilful misconduct, for unsafe goods or services, or for any liability that cannot be limited by law, including under sections 49, 51, 54, 55 and 61 of the CPA.
- Any notice that limits liability or asks you to accept a risk must be drawn to your attention in a clear and conspicuous way, before you pay or enter, as the CPA requires. Activities with a higher risk (for example workshops with equipment, fire performances or physical activities) may require a separate signed waiver, which will not remove your statutory rights.
- Subject to the law, we are not liable for indirect or consequential loss, such as travel, accommodation or time off work, where an Event is cancelled or changed for reasons outside our control. This does not apply where that exclusion would be unfair, unreasonable or unlawful.
- Events may be affected by circumstances outside our reasonable control, including severe weather, power or network failures, strikes, civil unrest, government action, disasters and health emergencies ("Force Majeure"). Section 9 sets out how we will treat you if this happens.
- We recommend that you consider your own insurance, including travel and event cancellation cover. Promoters must hold appropriate public liability insurance and comply with venue, safety and emergency regulations for their Events.
Cancellation, postponement and changes by the organiser
- Cancelled Events: if we cancel an Event before it starts, you will receive a full refund of the ticket price and any booking or service fees you paid, in money, to your original payment method, within a reasonable time. We aim to start the refund within 14 working days of announcing the cancellation, but your bank or Payment Provider's processing time may add to this.
- Postponed or rescheduled Events: your ticket remains valid for the new date. If you cannot attend the new date, you may request a refund within 7 working days of the new date being announced.
- Material changes: if the date, venue, advertised headline performer or format of an Event changes in a material way, and you do not accept the change, you are entitled to a refund. We will tell you about material changes as soon as reasonably possible and explain how to claim a refund.
- Events stopped or shortened: if an Event is stopped or significantly shortened for safety, weather, power, authority instructions or Force Majeure, we will tell you as soon as we can. If a significant part is not provided, we will offer a fair refund, which may be partial or full depending on how much was delivered.
- Changes to line-ups, set times, support acts, menus or features do not entitle you to a refund unless they amount to a material change under clause 9.3 or mean the Event is not as advertised.
- Vouchers, credits or transfers to a new date may be offered as an option, but you cannot be forced to accept a credit note or voucher instead of a refund you are entitled to by law. Any credit will be valid for at least three years.
- We are not responsible for your separate travel, accommodation or other third-party costs if an Event is cancelled or changed, except where the law says otherwise or where the cancellation is due to our fault and the loss was reasonably foreseeable.
- Announcements will be posted on the Event page and on Instagram (@silk.sundaes) and, where possible, sent by email or message to the contact details you gave. Keep your details up to date.
- The Promoter is responsible for refunds for its Event. If a Promoter cancels, becomes insolvent or does not pay refunds, you should tell us. We will use reasonable efforts to help, refund you ourselves where we hold the money, and take steps against the Promoter's licence, but we cannot guarantee refunds of funds we have not received.
- If you are removed from an Event for breaching this Policy, no refund is due.
Refunds if you cannot attend, and transfers
- A refund request may be considered only if it is received within seven (7) working days of the date of purchase. Working days exclude Saturdays, Sundays and public holidays in South Africa. If the Event itself takes place within that period, the ticket is not refundable under this section unless section 9 or the law applies.
- Requests must go to the Promoter contact on your ticket or, if none is given, by direct message to @silk.sundaes on Instagram. Include your name, booking reference, proof of payment, and the reason. We will confirm receipt and aim to respond within 5 working days.
- Where a refund is approved, we may deduct a reasonable cancellation fee that reflects our actual costs, the notice given and our ability to resell the ticket, in line with section 17 of the CPA. Any fee is shown to you before the refund is processed, and the refund is paid to your original payment method through Yoco or Paystack.
- After the 7 working day period, tickets are not refundable as a right. In exceptional circumstances only, at our discretion, we may grant a full or partial refund, a transfer or a credit. Examples include serious illness or injury supported by a medical certificate, death of the ticket holder or immediate family member with documentation, a duplicate purchase, or a processing error on our part. Each request is assessed on its own facts, and approving one request does not oblige us to approve another.
- Not all ticket types qualify for exceptional refunds. Promotional, discounted, early-bird, group, bundle or fixed-headcount catering tickets may be excluded or subject to different terms, but only if this was clearly shown before purchase.
- Bundles and multi-day passes: a refund may cover the unused portion where reasonable. Upgrades and downgrades are subject to availability and price differences.
- Transfers and name changes: where permitted for the Event, you may transfer your ticket to another person by notifying the Promoter or @silk.sundaes on Instagram before the Event, with the new Attendee's name and contact details. A reasonable administration fee may apply if disclosed.
- Tickets may not be resold for profit or commercial gain, or advertised above face value. Tickets sold or advertised in breach of this clause may be cancelled without a refund. We recommend selling through us or officially approved channels only, because tickets from unofficial sellers may be fake or already used.
- No refunds are given for no-shows, late arrival, change of mind, or being refused entry for a reason in this Policy, unless the law requires otherwise.
- Nothing in this section limits your rights under section 9, the CPA, ECTA or any other law.
Payments, fees, chargebacks and disputes
- Payments are accepted by the methods shown at checkout, processed by Yoco or Paystack. Foreign-issued cards may attract currency conversion or bank charges set by your bank. We do not control those charges.
- Refunds are paid in ZAR to the original payment method where possible. Once we have issued a refund, your bank or card issuer may take several working days to show it, and this is outside our control.
- We will not charge you the Payment Provider's processing fees on any refund you are legally entitled to, or on a cancellation by us. For discretionary refunds, a reasonable fee to cover non-recoverable provider costs may be deducted if shown to you beforehand.
- If you dispute a charge with your bank (a "chargeback"), please contact us first, as we can often resolve the problem faster. We will cooperate with the Payment Provider's process and provide the information it requires. A chargeback for a genuine purchase for an Event that went ahead may lead to your ticket being cancelled and future purchases being declined.
- We may delay or cancel a transaction that the Payment Provider flags as suspected fraud, and will tell you and refund you if the transaction is cancelled.
- Receipts or tax invoices are issued on request or by the Payment Provider. Keep your proof of payment for any queries.
- Payment problems that relate to the Payment Provider's service (for example card declines, 3-D Secure failures, account limits) should also be raised with the Payment Provider and your bank. We will assist where we can.
Privacy, recordings and your personal information
- We process personal information in line with the Protection of Personal Information Act 4 of 2013 ("POPIA"). Silk Sundaes and the Promoter of your Event are each a "responsible party" for information collected for that Event, and each is accountable for its own use. Our Information Officer can be reached through @silk.sundaes on Instagram.
- We collect what we need: your name, contact details, booking and payment references, age or ID confirmation, ticket and transfer details, communications with us, and information you give us about access, dietary or health needs, safety or GBV reports, and photos or recordings at the Event.
- We use it to sell and deliver tickets, run the Event, verify age and identity, keep people safe, handle refunds, reports and disputes, prevent fraud, improve our services, comply with the law, and, where you have agreed, send you marketing.
- Some information is sensitive, such as health, disability, religion, criminal behaviour (for bans) or details of GBV incidents, and information about children. We collect and use it only where you give consent, where it is necessary for a right or obligation in law, or where POPIA otherwise allows it, and we limit who can see it.
- We share information only where needed with the Promoter, Wix, Yoco and Paystack, ticketing and communication tools, venue, security, medical and emergency services, insurers, professional advisers, the police or regulators, and other Silk Sundaes Promoters for safety reasons where a person is banned. We do not sell your information. Operators must protect it, use it only for our purposes, and keep it confidential.
- Wix, Yoco and Paystack, and some of our other service providers, may store or process information outside South Africa. We will only share information abroad where the recipient is bound by law, binding rules or an agreement that gives similar protection, or where POPIA otherwise permits, such as where it is necessary to complete your purchase.
- We keep information only as long as needed for the purposes in this section, the law (for example tax and accounting rules), or to deal with claims and incidents. Safety and GBV records may be kept longer, but are protected and restricted. We use reasonable technical and organisational measures to secure information.
- Marketing: we send direct marketing only with your consent or where the law allows it to existing customers, with an easy way to opt out. Notices about your booking, changes and cancellations are not marketing.
- Recordings and CCTV: CCTV may operate for safety. Photography and filming may take place at Events for promotion and records, and signs will be displayed at entry. If you do not want to appear in promotional material, tell the photographer or staff, and we will make reasonable efforts to avoid or remove you on request. We will not publish images that are degrading, show a person in a vulnerable state, or identify someone who has made a report, without that person's consent. You may not record others in toilets, changing areas or private spaces.
- You may ask us to confirm what information we hold about you, and to see, correct or delete it, or object to its use, by contacting the Promoter or @silk.sundaes on Instagram. We may ask for ID to protect you, and some information may need to be kept by law.
- If you are unhappy with how we handle your information, please tell us first. You may also complain to the Information Regulator of South Africa.
- If there is a security compromise that affects your personal information, we will notify you and the Information Regulator as POPIA requires.
- Wix, Yoco, Paystack and Meta (Instagram) have their own privacy policies for the information they collect from you directly. Please read them as well. Our website may link to third-party sites that we do not control.
Promoter duties and brand standards
- A Promoter that runs an Event under the Silk Sundaes brand must follow this Policy, display or link to it at ticket sale and at the Event, and make sure its staff, security and vendors know the parts that apply to them.
- Promoters must obtain all required permits and licences (including liquor, safety, noise, health and fire approvals), keep a written safety and emergency plan, provide first aid, and carry appropriate public liability insurance.
- Promoters must advertise accurately, show their name and contact on all Event materials, disclose all fees up front, honour refunds and cancellation terms, and keep records of sales and refunds.
- Promoters must have a visible reporting process and trained safety contact for GBV and harassment (section 6), use licensed and trained security, and not tolerate or conceal abuse of any kind.
- Promoters must handle personal information lawfully under POPIA, use only the Payment Providers approved for their Event or ones agreed with Silk Sundaes, and must not use Attendee information for any other purpose.
- Promoters must report serious incidents (injury, assault, GBV, crowd emergency, major complaints) to Silk Sundaes promptly, and within 48 hours, and cooperate with any follow-up.
- If a Promoter does not comply, Silk Sundaes may require corrective action, suspend or end the Promoter's right to use the Silk Sundaes name, remove its Events from our channels, and tell affected customers. Nothing here limits any right you have directly against the Promoter or Silk Sundaes.
Changes, general terms, disputes and contact
- We may update this Policy from time to time. The updated Policy will be published on our website and Instagram page (@silk.sundaes) with a new "Last updated" date and, where reasonably possible, existing customers will be told of material changes.
- The version in force at the time of your purchase or booking applies to that purchase, and updates do not reduce rights you have already acquired. Safety and conduct rules (sections 4 to 7) apply at the Event as they stand on the day, if they do not reduce your statutory rights.
- If any part of this Policy is found to be unlawful or unenforceable, the rest continues to apply. If we do not enforce a term immediately, that does not mean we waive it.
- Notices to you may be sent by email, SMS, WhatsApp or Instagram message to the contact details you gave us, or posted on the Event page. Notices to us should go to @silk.sundaes on Instagram or to the Promoter named on your ticket.
- We aim to write this Policy in plain language. If you need help understanding it, or need it in another format, please contact us.
- Complaints: first contact the Promoter named on your ticket and, if still unresolved, Silk Sundaes on Instagram (@silk.sundaes), explaining what happened and what you would like us to do. We aim to respond within 5 working days and to resolve your complaint within 20 working days, and Silk Sundaes will follow up with Promoters where this Policy has not been followed.
- You may also approach the National Consumer Commission, the Consumer Goods and Services Ombud, the Information Regulator (for privacy), the police (for crimes), the Liquor Authority (for alcohol matters) or any court or forum with jurisdiction. We are open to mediation or alternative dispute resolution.
- This Policy is governed by the laws of the Republic of South Africa, and you consent to the jurisdiction of the South African courts, without limiting your right to approach a consumer forum.
Checkout acceptance wording
"I have read and accept the Silk Sundaes General Event Policy and Terms of Attendance, and the terms and privacy policies of Wix, Yoco and Paystack as they apply to my purchase. I understand that my Event may be run by an independent Promoter named on my ticket, that Silk Sundaes has zero tolerance for gender-based violence and harassment, that tickets are not refundable more than 7 working days after purchase except in exceptional or legally required circumstances, that my personal information will be handled as described in section 12, and that the policy may be updated from time to time."
